Fanshawe Innovation Research Scholarship Teaching
TERMS OF USE
These Terms of Use apply to your use of FIRST (Fanshawe Innovation Research Scholarship Teaching), Fanshawe College’s online open access institutional repository. By using FIRST as i) an Author uploading Work(s) to be available for public viewing, accessing, downloading, and copying by Users and exhibiting, distributing, communicating, preserving, and use for marketing and promotional purposes by Fanshawe College, and as ii) a User publicly viewing, accessing, downloading, and copying Works, you are agreeing to these Terms of Use.
Submission Process
Current Faculty, Staff, and Administrators of Fanshawe College may submit Works and any Associated Files to FIRST that are scholarly in nature and creative. Faculty may sponsor Student Works that demonstrate exemplary learning and quality in teaching.
Examples of Works that may be submitted to FIRST include: Student Works assessed and sponsored by Faculty; working papers, technical reports, and research papers; conference proceedings such as papers, presentation slides, programs, and posters; journal articles, magazine articles, and essays; creative works such as artwork, photographic works, music, recorded performances, and videos; primary research; books and book chapters.
Examples of Associated Files that may be submitted to FIRST to accompany a Work submitted to FIRST include: clips, data sets, images, videos, and research and speaking notes.
Works and Associated Files in all file types and formats may be submitted to FIRST electronically via the Submit Your Research page which can be accessed by clicking on the Submit Research link that is located on the sidebar of the FIRST homepage.
Representation of Original Authorship
Works and Associated Files submitted to FIRST must be original to and authored by Faculty, Staff, or Administrators of Fanshawe College. Student Works must be original to and authored by Students of Fanshawe College and those Students and their Student Works must be sponsored by Faculty of Fanshawe College in order to be submitted to FIRST.
The Author (Faculty, Staff, Administrator, or Student) must own the copyright to all components of the Work and any Associated Files and all content within the Work and any Associated Files or, must have received and be able to produce permission from the appropriate Copyright Owner(s) to submit the Work and any Associated Files to FIRST so that it may be available for public viewing, accessing, downloading, and copying.
The Author must sign a license agreement prior to submitting a Work and any Associated Files to FIRST. This license agreement grants Fanshawe College the perpetual, non-exclusive, royalty-free, worldwide permission to make the submitted Work and any Associated Files available for public viewing, accessing, downloading, and copying via FIRST and to exhibit, distribute, communicate, preserve, and use for marketing and promotional purposes, the submitted Work and any Associated Files.
Copyright and Permissions
The Work that you create will be protected by copyright and the ownership of the rights that copyright law extends to the Authors of Works will vary based on the circumstances under which the Work was created. If you are Faculty, the rights to a Work created as part of your employment duties at Fanshawe College will be owned by Fanshawe College while the rights to a Work created as part of a research endeavor that is external to Fanshawe College may be jointly owned by you, your research partner(s) and/or your publisher. If you are a Student, the rights to a Work created as the result of an assignment or project will be owned by you while the rights to a Work created as part of a co-op or apprenticeship may be jointly owned by you and your employer.
During the process of submitting a Work and any Associated Files to FIRST, you will be required to sign a license agreement granting Fanshawe College permission to publish your submitted Work and any Associated Files via FIRST. Before granting such permission, it is recommended that you confirm who owns the rights to the Work and any Associated Files that are to be submitted to FIRST and whether you are authorized to grant Fanshawe College permission to publish the submitted Work and any Associated Files via FIRST.
If the Work and Associated Files you are submitting to FIRST contain copyright-protected components or content such as images, text, media, etc., the rights to which may belong to another individual or entity, it is your responsibility to receive and be able to produce permission from the appropriate Copyright Owner(s) to submit the Work and any Associated Files, and any components or content therein, to FIRST so that it may be available for public viewing, accessing, downloading, and copying.

Duration of Terms of Use and License Agreement
Once submitted to FIRST, Works and any Associated Files will be available via FIRST for the purposes of public viewing, accessing, downloading, copying, exhibiting, distributing, communicating, preserving, and use for marketing and promotional purposes in perpetuity.
If an Author who has submitted Work(s) and any Associated Files to FIRST leaves Fanshawe College, their Work(s) and any Associated Files will remain available via FIRST for public viewing, accessing, downloading, and copying. Requests to have an Author’s displayed contact information edited may be submitted by the Author to the FIRST Administrators at FIRST@fanshawec.ca.
Revision of Submitted Work
An Author may submit to FIRST a revised version of a Work or Associated File that has previously been submitted to FIRST. Displaying revised versions of a Work or an Associated File alongside the previously submitted Work or Associated File is the preferred method of demonstrating the progress of a Work or Associated File.
The replacement of Works or Associated Files with edited versions of Works or Associated Files will be considered and processed by FIRST Administrators. Requests to replace Works or Associated Files can be submitted to the FIRST Administrators at FIRST@fanshawec.ca.
Withdrawal of Submitted Work
FIRST is meant to be a permanent online open access institutional repository that provides consistent access to Fanshawe College’s scholarly and creative output. Withdrawing Works and any Associated Files is discouraged. Once submitted, neither a Work nor an Associated File will be withdrawn although under some circumstances, such as copyright infringement, privacy violations, plagiarism, or other proven illegal activities, a Work or Associated File will be removed from FIRST.
Requests for the withdrawal of a Work or Associated File must be sent to the FIRST Administrators at FIRST@fanshawec.ca. A statement as to the reason for the requested withdrawal of a Work or Associated File must be provided. FIRST Administrators will respond to requests for the withdrawal of a Work or Associated File within five (5) business days.
Removal of Submitted Work
The FIRST Administrators will remove Works and any Associated Files from FIRST if copyright infringement, privacy violations, plagiarism, or other illegal activities are proven. Removed Works and any Associated Files will no longer be available for public viewing or access but they will not be deleted unless there is legal requirement to delete the Works and any Associated Files entirely.
Authors and Copyright Owners may request that a Work or Associated File be removed from FIRST due to copyright infringement, privacy violations, plagiarism, or other proven illegal activities by contacting the FIRST Administrators at FIRST@fanshawec.ca.
The Faculty, Staff, Administrator, or Student and Sponsoring Faculty who submitted a Work or Associated File to FIRST will be contacted by FIRST Administrators prior to the removal of that Work or Associated File from FIRST.
Access and Use
Works and any Associated Files on FIRST are available for non-commercial purposes of public viewing, accessing, downloading, and copying by any person or organization, free of charge.
It is the User’s responsibility to understand the conditions under which they may view, access, download, and copy Works and any Associated Files available via FIRST. Unless otherwise indicated, Users may view, access, download, and copy Works and any Associated Files available via FIRST for non-commercial purposes as long as appropriate acknowledgement is given, appropriate citations are employed, and the Works and any Associated Files are not altered in any way without the consent of the Author(s) and applicable Copyright Owner(s). For any and all uses outside of this scope, the User must contact the Author(s) and applicable Copyright Owner(s) or email the FIRST Administrators at FIRST@fanshawec.ca.
